Terms and Conditions

1. Acceptance of Terms

By requesting, contracting, or using any service provided by The World Testers (hereinafter “the Brand” or “we”), available through theworldtesters.com, you (hereinafter “the Client”) agree to be bound by these Terms and Conditions. If you do not agree, please refrain from using our services.

These Terms apply to individuals and legal entities in any jurisdiction, including Mexico, Latin America, the United States of America, European Union member states, and any other region where our services are available.

 

2. Description of Services

The World Testers provides professional evaluation, testing, and optimization services for websites and digital applications, including but not limited to:

  • Functional validation and quality assurance/engineering (QA/QE)
  • User experience (UX) and user interface (UI) evaluation
  • Performance and page load speed testing, including Core Web Vitals
  • Web accessibility analysis (WCAG compliance)
  • Technical SEO review
  • Automated test script generation (Selenium and similar tools)
  • Prioritized improvement recommendations and consulting
  • Digital product adaptation and localization for specific markets

 

3. Service Agreement Process

Services are formalized through an agreement between the parties as follows:

  • Initial request: the Client submits the contact form or emails contact@theworldtesters.com
  • Proposal: the Brand sends a proposal detailing scope, deliverables, timeline, and price
  • Acceptance: the Client confirms in writing (email or other digital means)
  • Project start: once the agreed deposit is received, the project begins

The Brand reserves the right to accept or decline any service request without being required to provide justification.

 

4. Fees, Payments, and Billing

Fees will be those agreed upon in the proposal accepted by the Client. Unless otherwise agreed:

  • A 50% deposit is required before project commencement
  • The remaining balance is due upon delivery of final results
  • Prices are expressed in USD for international clients, or MXN for clients in Mexico, as agreed
  • Billing documentation will be issued in accordance with the applicable tax regulations at each stage of the Brand’s development
  • Payment is made through the methods communicated in the proposal

Payments are non-refundable once service execution has begun, except in cases of demonstrable non-performance by the Brand.

 

5. Client Obligations

For the proper delivery of services, the Client agrees to:

  • Provide timely access to the environments, platforms, or materials required for evaluation
  • Designate a point of contact responsible for the project
  • Review and approve deliverables within the agreed timeframes
  • Not use the services for illegal purposes or in violation of third-party rights
  • Ensure they hold the necessary rights over the websites or applications to be evaluated

 

6. Intellectual Property

6.1 Brand ownership

Methodologies, proprietary tools, templates, and processes developed by the Brand are and shall remain its exclusive property.

6.2 Project deliverables

Reports, scripts, documentation, and other deliverables produced specifically for the Client will be transferred to the Client upon full payment of the service.

6.3 Client ownership

The Client’s website, source code, brand identity, and digital assets remain at all times the exclusive property of the Client.

 

7. Confidentiality

Both parties agree to maintain the confidentiality of all information exchanged during the provision of services. The Brand will not disclose the Client’s data, code, strategies, or any sensitive information to third parties, except when required by law. This obligation extends for three (3) years following the completion of the service.

 

8. Limitation of Liability

  • Evaluation services are advisory in nature and do not guarantee specific commercial outcomes
  • The Brand shall not be liable for indirect damages, loss of profits, or data loss
  • The Brand’s maximum liability shall not exceed the total amount paid for the service in question
  • The Brand is not responsible for failures caused by third parties (platforms, hosting providers, etc.)

 

9. Modification and Termination of Service

Any changes to the project scope must be agreed upon in writing and may result in adjustments to price and timeline. Either party may terminate the agreement with 15 calendar days’ prior notice. In the event of early termination by the Client, the Client shall pay for services rendered up to that date.

 

10. Governing Law and Dispute Resolution

The parties commit to seeking an amicable resolution before initiating legal proceedings. If no resolution is reached:

  • Clients in Mexico: governed by the laws of the United Mexican States; courts of Monterrey, Nuevo Leon
  • Clients in the European Union: the non-waivable consumer rights of the client’s country of residence shall be respected
  • Clients in the United States: arbitration or competent court in the agreed state
  • Other regions: the applicable jurisdiction will be agreed upon in the commercial proposal

 

11. Region-Specific Provisions

Mexico — LFPDPPP and PROFECO

Data processing is governed by the LFPDPPP. Mexican consumers are entitled to the ARCO rights described in the Privacy Notice.

European Union — GDPR

For users in the European Economic Area, the General Data Protection Regulation applies. The legal basis for processing is consent or the performance of a contract, as applicable.

United States — CCPA / CPRA (California)

California residents have the right to know what personal data is collected, to request its deletion, and to not be discriminated against for exercising their privacy rights, under the CCPA and CPRA.

Latin America — Argentina, Brazil, Colombia, Chile, and others

The Brand will comply with the principles of purpose, consent, and access established in the applicable local legislation (Law 25.326, LGPD, Law 1581, Law 19.628, and equivalents).

 

12. Changes to These Terms

The Brand may modify these Terms at any time. Changes will be communicated on theworldtesters.com with at least 15 days’ notice before taking effect. Continued use of the services after that date implies acceptance of the updated terms.
